By accessing this Site, creating an account, or purchasing products from Ghost Tier Gear, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, you must discontinue use of this Site immediately.

Ghost Tier Gear does not warrant that:

Specifications are always current.
Colors or finishes displayed on your screen accurately represent the actual product.
Manufacturer specifications will remain unchanged.

Some products sold through Ghost Tier Gear are fulfilled directly by manufacturers, distributors, or third-party fulfillment partners. As a result, shipping methods, packaging, and delivery times may vary depending on the specific product ordered.

6. PRICING & PAYMENT

All prices displayed on GhostTierGear.com are listed in United States Dollars (USD) unless otherwise indicated.

Ghost Tier Gear reserves the right to modify pricing, promotions, discounts, product availability, or specifications at any time without prior notice.

While every effort is made to ensure pricing accuracy, occasional typographical errors, system errors, synchronization issues with suppliers, or pricing anomalies may occur. Ghost Tier Gear reserves the right to cancel or refuse any order placed for a product listed at an incorrect price, regardless of whether the order has been confirmed or payment has been received. If payment has already been processed, a full refund will be issued to the original payment method.

Prices displayed on the Site do not include applicable sales tax, shipping charges, insurance, or other fees unless expressly stated during checkout.

Customers are responsible for paying all applicable taxes required by federal, state, or local law.

Ghost Tier Gear accepts payment methods made available through our secure checkout platform. By submitting payment information, you represent and warrant that:

Ghost Tier Gear reserves the right to delay shipment pending payment verification or fraud review.

7. ORDER ACCEPTANCE, MODIFICATION & CANCELLATION

Submission of an order through GhostTierGear.com does not constitute acceptance of that order.

Your order represents an offer to purchase products subject to these Terms. An order is considered accepted only after it has been reviewed, processed, and prepared for shipment by Ghost Tier Gear.

Ghost Tier Gear reserves the right to refuse, cancel, modify, or limit any order for any lawful reason, including but not limited to:

Inventory shortages.
Product discontinuation.
Pricing or listing errors.
Manufacturer supply issues.
Suspected fraud.
Payment authorization failure.
Duplicate orders.
Orders placed by resellers where prohibited.
Orders that violate applicable law.
Orders containing inaccurate customer information.
Orders that cannot legally be shipped to the customer's location.

If an order is canceled after payment has been collected, Ghost Tier Gear will issue a refund to the original payment method.

Customers wishing to cancel an order should contact our support team as soon as possible.

While we will make reasonable efforts to accommodate cancellation requests, we cannot guarantee cancellation once an order has entered processing, fulfillment, or shipment.

Special-order items, custom products, limited-production items, or products ordered specifically from a manufacturer may not be eligible for cancellation after purchase.

Ghost Tier Gear reserves the right to limit purchase quantities on products experiencing unusually high demand or limited availability.

8. FRAUD PREVENTION & ORDER VERIFICATION

Protecting our customers from fraud is a priority.

Ghost Tier Gear reserves the right to review any order that appears unusual, inconsistent, or potentially fraudulent.

Orders may be delayed while additional verification is completed.

Ghost Tier Gear may request additional information before processing an order, including but not limited to:

Government-issued identification.
Billing address verification.
Confirmation of shipping information.
Payment verification.
Telephone confirmation.
Additional documentation reasonably necessary to verify identity.

Failure to provide requested verification information may result in cancellation of the order.

Ghost Tier Gear reserves the right to refuse service to any customer engaging in fraudulent activity, attempted payment fraud, unauthorized chargebacks, identity theft, abuse of promotional offers, or any conduct reasonably believed to threaten the security of our business or customers.

We also reserve the right to report suspected fraudulent activity to payment processors, financial institutions, shipping carriers, and law enforcement agencies where appropriate.

Customers who initiate chargebacks without first attempting to resolve an issue with Ghost Tier Gear may have future purchasing privileges revoked.

9. SHIPPING & DELIVERY

Ghost Tier Gear currently ships only to addresses within the United States.

Certain products may be unavailable for shipment to specific states or local jurisdictions due to applicable laws or manufacturer restrictions.

Customers are solely responsible for ensuring that products ordered may legally be shipped to and possessed within their jurisdiction.

Estimated shipping dates displayed on the Site are estimates only and are not guaranteed.

Delivery times may vary due to:

Manufacturer availability.
Distributor inventory.
Carrier delays.
Weather conditions.
Natural disasters.
Holidays.
Supply chain disruptions.
Customs or regulatory inspections.
Other events beyond our reasonable control.

Ghost Tier Gear fulfills orders using a combination of:

In-house inventory.
Manufacturer direct shipments.
Authorized distributors.
Third-party fulfillment partners.

Accordingly, products within the same order may ship separately and arrive on different dates.

Customers will receive shipment tracking information when available.

Ghost Tier Gear is not responsible for delays caused by shipping carriers after packages have been accepted for transportation.

Incorrect shipping information provided by the customer may result in additional shipping charges or delays.

Customers are responsible for ensuring that shipping addresses are accurate before submitting an order.

Orders returned due to an incorrect address, refusal of delivery, or failure to claim a shipment may be subject to additional shipping charges and applicable restocking fees.

10. RISK OF LOSS, TITLE & DELIVERY ISSUES

Unless otherwise required by applicable law, title to products purchased through GhostTierGear.com passes to the customer when the shipment is tendered to the shipping carrier.

Risk of loss likewise transfers to the customer upon acceptance of the shipment by the carrier.

Ghost Tier Gear is not responsible for:

Delays caused by shipping carriers.
Lost shipments after carrier acceptance when delivery confirmation exists.
Porch theft or package theft after confirmed delivery.
Damage occurring after delivery.
Delivery delays caused by weather or natural disasters.
Incorrect delivery due to inaccurate customer-provided address information.
Carrier routing errors outside our control.

Customers are encouraged to inspect shipments promptly upon delivery.

Any claims involving damaged merchandise should be reported to Ghost Tier Gear within five (5) business days of delivery.

If a shipment appears damaged upon arrival, customers should retain all original packaging and, when possible, photograph the damaged package and contents before contacting customer support.

Ghost Tier Gear will work in good faith with customers to assist in filing carrier claims when appropriate; however, Ghost Tier Gear cannot guarantee the outcome of any carrier investigation or reimbursement request.

For high-value shipments, Ghost Tier Gear reserves the right to require signature confirmation, adult signature, insurance, or other delivery verification methods at our sole discretion.

If a package is returned to Ghost Tier Gear due to refusal of delivery, failure to claim the package, or incorrect address information supplied by the customer, the customer may be responsible for additional shipping costs and applicable restocking fees before the order is re-shipped or refunded.

11. RETURNS, REFUNDS & EXCHANGES

Ghost Tier Gear is committed to providing quality products and excellent customer service. If you are not satisfied with your purchase, we will work with you to resolve the issue in accordance with this Return Policy.

Unless otherwise stated, merchandise may be returned within thirty (30) calendar days of the date of delivery.

To be eligible for a return, products must:

Be unused and in original condition.
Include all original packaging, manuals, accessories, inserts, and components.
Be free from damage, modification, installation, or excessive wear.
Include proof of purchase.

Customers must obtain a Return Merchandise Authorization ("RMA") from Ghost Tier Gear before returning any merchandise. Returns received without prior authorization may be refused or returned to the sender.

Customers are responsible for all return shipping costs unless the return is the result of our shipping error or a verified manufacturer defect.

Approved returns may be subject to a restocking fee of up to ten percent (10%) of the purchase price. The exact fee, if any, will depend on the condition of the returned merchandise and any costs incurred by Ghost Tier Gear in processing the return.

The following items are generally not eligible for return unless required by applicable law:

Products that have been installed or used.
Firearm parts showing signs of installation.
Clearance or closeout merchandise.
Special-order or custom-order products.
Products sold "As Is."
Gift cards.
Digital products.
Items marked "Final Sale."
Products missing original packaging or accessories.
Promotional or giveaway items.

Refunds will be issued only after returned merchandise has been received and inspected.

Approved refunds will be issued to the original payment method. Original shipping charges are non-refundable except where required by law or when the return results from an error by Ghost Tier Gear.

Ghost Tier Gear reserves the right to deny any return that does not comply with this policy.

Exchanges are processed based on product availability and are handled as a return followed by a new purchase unless otherwise determined by Ghost Tier Gear.

12. PRODUCT COMPATIBILITY & CUSTOMER RESPONSIBILITY

Ghost Tier Gear sells products manufactured by a variety of companies. While we strive to provide accurate compatibility information, customers are solely responsible for determining whether a product is appropriate for their intended firearm, equipment, or application before purchasing.

Manufacturers may revise product specifications, dimensions, tolerances, finishes, or designs without prior notice.

Ghost Tier Gear makes no representation that any product will fit every firearm or configuration described by a manufacturer.

Customers are encouraged to consult firearm manufacturers, product manufacturers, or qualified gunsmiths whenever compatibility is uncertain.

Ghost Tier Gear shall not be responsible for costs associated with:

Products should be inspected prior to installation. Customers should discontinue installation immediately if any issue or incompatibility is identified.

13. FIREARM ACCESSORY COMPLIANCE & LEGAL RESPONSIBILITY

Ghost Tier Gear does not provide legal advice regarding firearm laws.

Federal, state, and local laws governing firearm accessories frequently change and vary significantly by jurisdiction.

It is solely the customer's responsibility to determine whether any product purchased from Ghost Tier Gear may be lawfully:

Purchased.
Possessed.
Imported.
Installed.
Used.
Transported.
Resold.

Ghost Tier Gear reserves the right to:

Refuse shipment of any product prohibited by applicable law.
Cancel any order that cannot legally be fulfilled.
Restrict shipments to specific states, counties, or municipalities.
Require additional documentation before shipment where permitted by law.

Customers acknowledge that they are solely responsible for ensuring compliance with all applicable laws before placing an order.

Ghost Tier Gear shall not be responsible for products confiscated, seized, delayed, or prohibited by governmental authorities due to local legal restrictions.

Warranty coverage, repair decisions, replacements, and turnaround times are determined exclusively by the manufacturer.

Shipping costs associated with manufacturer warranty claims.
Manufacturer repair decisions.

Defects will be corrected.

DELAYED SHIPMENTS

UNDER NO CIRCUMSTANCES SHALL GHOST TIER GEAR'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE CUSTOMER FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

Nothing contained herein shall limit liability where such limitation is prohibited by applicable law.

22. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Division 80, LLC d/b/a Ghost Tier Gear and its owners, officers, directors, employees, contractors, affiliates, successors, assigns, suppliers, manufacturers, distributors, and representatives from and against any claims, damages, liabilities, judgments, settlements, losses, costs, expenses, or attorneys' fees arising out of or relating to:

Your use of the Site;
Your purchase or use of any products;
Your violation of these Terms;
Your violation of any law or regulation;
Your negligent or intentional acts or omissions; or
Your infringement of the rights of any third party.

This indemnification obligation survives termination of these Terms and your use of the Site.

Supply chain disruptions
Manufacturer shortages
Carrier delays
Acts of war
Terrorism
Civil unrest

Performance shall be suspended for the duration of such event without liability.

24. PRIVACY

Your use of GhostTierGear.com is also governed by our Privacy Policy, which describes how we collect, use, store, and protect personal information.

By using the Site, you acknowledge that you have reviewed our Privacy Policy and consent to the collection and use of information as described therein.

If any provision of these Terms conflicts with the Privacy Policy, these Terms shall govern with respect to contractual matters, while the Privacy Policy shall govern the handling of personal information.

Ghost Tier Gear reserves the right to suspend, restrict, or terminate access to the Site or any customer account at any time, with or without notice, if we reasonably believe that a user has:

Abused return policies;
Initiated improper chargebacks;
Interfered with Site operations; or

Termination of access does not relieve either party of obligations that accrued prior to termination.

26. GOVERNING LAW & VENUE

These Terms and all disputes arising from or relating to the Site, any Order, or any Product shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Unless otherwise required by applicable law, any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located within the State of Texas.

By using the Site, you consent to the personal jurisdiction and venue of such courts.

27. SEVERABILITY

If any provision of these Terms is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

28. WAIVER

The failure of Ghost Tier Gear to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Any waiver shall be effective only if made in writing and signed by an authorized representative of Ghost Tier Gear.

29. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and any additional policies expressly incorporated by reference, constitute the entire agreement between you and Ghost Tier Gear concerning your use of the Site and the purchase of Products.

These Terms supersede all prior or contemporaneous communications, representations, understandings, or agreements relating to the same subject matter.
